Terms of Service

1. About the service

powellriverrentals.ca (the “Service”) is operated by Powell River Rentals (“we”, “us”). It is a free directory where landlords publish rental listings and renters find them. The Service is free to use; we don't charge renters or landlords.

We are not a party to any tenancy. We are not a landlord, property manager, real estate licensee or agent for anyone. Any tenancy is solely between the landlord and the tenant.

We don't verify listings. We don't inspect homes, confirm who owns them, or screen landlords or renters. Listings are written by landlords, who are responsible for them. We may review, edit or remove listings, but we are not obliged to.

2. For renters

• Messages you send through a listing are forwarded to the landlord by email and not stored by us. Applications are made through the landlord's own form, directly to the landlord.
• Protect yourself from scams. Never send a deposit, rent or any money before you've viewed the home in person (or had someone you trust do so) and signed a written tenancy agreement. Be wary of anyone who can't show you the home or pressures you to pay quickly. Report suspicious listings to support@powellriverrentals.ca.
• In British Columbia, landlords can't charge a fee to apply for a rental. If a listing asks for one, please tell us.
• Alert emails can be turned off anytime using the unsubscribe link in each email.

3. For landlords

To create an account you must be at least 19 and able to form a binding contract. You're responsible for keeping your login secure and for everything done through your account. By listing a home, you confirm and agree that:

• you own the home or are authorized by the owner to rent it, and it's genuinely available;
• your listing is accurate and not misleading, and you'll unpublish it promptly once it's rented;
• you'll comply with the BC Residential Tenancy Act and regulations, including the prohibition on charging application fees and the limits on deposits;
• you won't discriminate against anyone in advertising or choosing a tenant contrary to the BC Human Rights Code, including by stating preferences based on protected characteristics such as race, religion, family status, disability, sex, sexual orientation, age or lawful source of income, except where the Code expressly permits;
• you're responsible for any application form you link to, for the messages renters send you, and for collecting, using, securing and deleting applicants' personal information in compliance with BC privacy law;
• you have the rights to all photos and text you upload.

You keep ownership of your content. You grant us a non-exclusive, royalty-free licence to host, display, format and share it (for example in alert emails and search results) to operate and promote the Service, for as long as it's published.

4. What nobody may do

• post fake, fraudulent, bait-and-switch or duplicate listings, or list a home you're not authorized to rent;
• use the Service to scam, harass or collect money under false pretences;
• post content that is unlawful, discriminatory, hateful or infringes anyone's rights;
• scrape, copy or harvest listings or contact details in bulk, or use them for spam or marketing;
• interfere with the Service's security or operation, or access accounts or data that aren't yours.

We may remove content or suspend or close accounts that break these terms, at our discretion and without notice where we reasonably believe it's needed to protect users.

5. Sponsorship

The Service is sponsored by Sydney Young, a local mortgage professional. Using the Service never obliges you to use any financial service, and nothing on the site is financial, legal or tax advice. We don't share your information with our sponsor; see our Privacy Policy.

6. Features and changes

Some features are marked “coming soon” and aren't available yet. We may add, change or discontinue features, and we may update these terms. If we make a material change, we'll update the date above and, for landlords, notify you by email. Continuing to use the Service after changes take effect means you accept them.

7. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the accuracy of listings, the conduct of landlords or renters, the condition or legality of any home, or that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, we aren't liable for any indirect, incidental, special or consequential damages, or for any loss arising from a listing, a tenancy, dealings between users, or money you pay to anyone. Because the Service is free, our total liability for any claim relating to it is limited to $100 CAD. Nothing in these terms limits liability that can't be limited by law.

9. Indemnity

Landlords agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from their listings, their tenancies, their handling of applicants' information, or their breach of these terms or the law.

10. Ending your use

You can stop using the Service anytime, and landlords can ask us to delete their account by emailing support@powellriverrentals.ca. Sections that by their nature should survive (such as disclaimers, liability limits and indemnity) continue to apply.

11. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Any dispute will be resolved in the courts of British Columbia.
